Maskeraad OÜ, registry code 11554291, address Vuti 11, 10619 Tallinn (hereinafter Store Operator; office and warehouse: Pirni 5, Tallinn), and the customer who places an order in the online store MASKERAAD.EE managed by Maskeraad OÜ and provides personal data for the order (hereinafter Customer), agree to the following terms.


1. General Provisions

1.1. The Parties shall be governed by the laws of the Republic of Estonia and other applicable legislation, as well as this Agreement.
1.2. The Store Operator has the right to make changes to the online store service at any time.
1.3. The Store Operator has the right to unilaterally amend these terms without prior obligation to notify the Customer by e-mail. Significant changes will be announced on the store’s website.


2. Products and Ordering

2.1. Not all products displayed in the online store may always be in stock; the “Out of Stock” label indicates that the product is not currently available.
2.2. If a product is unavailable and the order cannot be fulfilled, the Store Operator will contact the Customer within 3 working days. A new delivery time or an equivalent replacement will be offered. If the Customer does not agree, the order will be cancelled, and the amount paid will be refunded.
2.3. Product photos are illustrative and may differ from the actual product. If the product differs significantly from its description or image, the Customer has the right to withdraw from the contract or request correction/replacement.
2.4. Product descriptions may contain errors and may not be exhaustive.
2.5. The Customer must provide correct data required for fulfilling the order. The Store Operator is not liable for delays or issues caused by incorrect data provided by the Customer.
2.6. The order confirmation is deemed a binding sales contract from the moment the total payable amount is received by the Store Operator’s account or the payment service provider (Maksekeskus.ee).


3. Prices and Payment

3.1. All prices are in euros and include VAT.
3.2. The Store Operator has the right to change prices, but changes do not affect already confirmed and paid orders.
3.3. The Customer may pay by bank transfer or via bank link using the Maksekeskus.ee interface.
3.4. The order must be paid on the same day it is placed. If payment is not received by the due date, the order will be cancelled.


4. Delivery Time and Terms

4.1. Orders are generally processed on the same working day; if necessary, the Customer will be contacted no later than the following working day.
4.2. The delivery time for in-stock products is up to 5 working days, usually 1 working day. If delivery is delayed, the Customer will be informed and has the right to cancel the order.
4.3. The Customer can choose:
- pickup at Pirni 5, Tallinn (no delivery charge),
- DPD courier to home or office,
- DPD parcel locker.
4.4. Upon receipt of goods, an identity document must be presented. The goods will be handed over to the buyer or their authorised representative.
4.5. Parcels are stored in the parcel locker for 7 days.


5. Failure to Pick Up or Accept Goods

5.1. If the Customer has chosen pickup from Maskeraad OÜ warehouse (Pirni 5, Tallinn), the goods must be collected within 14 (fourteen) days from the notification of readiness. If the Customer fails to collect within this period, it shall be deemed a withdrawal from the purchase by the Customer.
5.2. In such cases, Maskeraad OÜ will refund the amount paid by the Customer within 14 days from the moment the goods are returned to stock. Actual processing costs related to the order will be deducted from the refund.
5.3. If the Customer does not collect the parcel from a parcel locker or refuses to accept delivery from a courier, it will be deemed a withdrawal from the purchase by the Customer. Maskeraad OÜ will refund the Customer within 14 days from the return of the goods to Maskeraad OÜ. The refund will be reduced by actual costs incurred for shipping and return (including courier or parcel locker fees).


6. Withdrawal Before Fulfilment

6.1. If the Customer wishes to withdraw from the contract after placing the order but before fulfilment, they must notify the Store Operator immediately. Notice must be sent by e-mail to [email protected] or by calling +372 5307 6005.
6.2. If the withdrawal notice reaches the Store Operator after the order has been fulfilled, withdrawal will take place according to the chapter “Right of Return.”
6.3. The Store Operator will refund the Customer within 14 days of receiving the withdrawal notice. The refund will be made to the same bank account from which the payment was received.


7. Personal Data and Its Use

7.1. The Customer gives clear and informed consent to the Store Operator for processing their personal data.
7.2. Personal data provided by the Customer when placing an order will be entered into the customer database and used to provide sales services and offer products to the Customer.
7.3. The source of personal data is the creation of a customer relationship upon registration of the order or subscription to the newsletter.
7.4. Registered personal data includes: name, surname, street, house/apartment number, city/town, postal code, phone number, year of birth, gender, delivery method, payment method, agreement to the terms of service, marketing consent, and any additional notes.
7.5. Data necessary for delivery may be transferred to the courier company.
7.6. The Store Operator will not share personal data with unauthorised third parties.
7.7. The Store Operator reserves the right to transfer personal data to authorities if required by law or if it is necessary to protect the life, health, or freedom of the Customer or another person.
7.8. The Customer has the right to review, modify, or delete their personal data in the customer database by using the online store link “My Personal Info.”
7.9. The Customer agrees that the Store Operator may send order confirmations and updates regarding order status to the e-mail address provided.
7.10. The Customer agrees that the Store Operator may send marketing offers to the e-mail address provided, if the Customer has consented by ticking the corresponding box when placing the order.
7.11. Maskeraad OÜ processes personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and the laws of the Republic of Estonia. More details on processing can be found in our Privacy Policy.

8. Acceptance of Terms

8.1. Familiarisation with these terms is mandatory for the Customer.
8.2. By ticking the box “I agree to the terms and conditions” when placing an order, the Customer confirms that they have read, understood, and accepted these terms.


9. Complaints Procedure

9.1. In the event of defective goods, the Customer has the right to submit a complaint within two years from the date of receipt of the goods.
9.2. Complaints must be submitted without delay, but no later than two months after discovering the defect.
9.3. Complaints must be submitted in writing and will be answered within a reasonable time.


10. Liability and Force Majeure

10.1. The Store Operator and the Customer are liable for damages caused to each other in cases and to the extent provided by the laws of the Republic of Estonia.
10.2. The Store Operator is not liable for delays or damages caused by force majeure.
